  Sub: Memorandum of Interim Relief and merger of Dearness allowance.

            The National Secretariat of the Confederation of Central Government employees and workers places on record its appreciation over the efforts of the Staff Side,  JCM,  National Council in preparing and submitting the memorandum to the 7th Central Pay Commission, which has received the widest acceptance and admiration of the Central Government employees. Since the last date for submitting the Department-specific memorandum has been got extended by your efforts uptill 31st July, 2014, the first phase of our endeavour and interaction with the 7th CPC will come to a conclusion in a few days’ time.

       I have been directed by the National Secretariat of the Confederation which met on 17thJuly, 2014 to solicit your kind reference to the memorandum submitted by the Staff Side on behalf of all Federations, Unions, Associations on Interim Relief and merger of Dearness allowance.  We are of the view that the Staff Side, in pursuance of the said memorandum, must seek an audience with the Pay Commission immediately to know the course of action the Commission would like to take in the matter.  We must also seek an appointment with the honourable Finance Minister thereafter so as to ensure that a decision on our demands is taken by the Government without any further delay.  We hope we need not emphasise the fact that the Central Government employees do expect financial benefit on this score as the erosion in the real value of wages as on date is phenomenal.

Sub: Submission of a memorandum to solve some burning divisional problems.

Sir,
            This is for your kind information that at the call of NFPE Group of Postal Unions, Howrah Division organised a “Deputation” at 17.00 hrs on 24-07-2014 before your chamber and all the burning problems as faced by all cross-sections of postal employees of our division is submitted herewith in a form of a “Memorandum” for its speedy settlement. Otherwise, we have to start strong trade union movement through out the division. Hope, you will take immediate steps towards the settlement of the following issues.
                                                                        MEMORANDUM

1.      Non-holding of DPC for the vacancies of the departmental quota of Postman & MTS Cadre (to be filled from the senior GDS officials) since long.
2.      Non-holding of DPC for remaining MACP cases in respect of PA, Postman & MTS cadre.
3.      Abnormal and illegal “redeployment” of Postman Employees in the PA cadre at Howrah HO.
4.      Partial and motivated role of the divisional administration regarding the implementation of the order of termination of attachment of Group-C employees, violating the instruction issued by the Postmaster General, South Bengal Region.
5.      Forced Merger of the Business Office of Howrah Division with the RMS, WB Division by the administration without taking the views of the Service Union, resulting in loss of revenue.
Note: - After merger of Business Office of Howrah Division, major portion of the business has been unattended by the MBC, Howrah RMS (WB Division).
6.      Abnormal & whimsical closure of all the un-settled old agenda in the minutes of our monthly meeting due to unilateral decision of the divisional administration and distorting the fact .
7.      Filling up of all the vacant GDS posts thorough out the division.
8.      Provide the manpower in the vacant posts/sudden leave vacancies of Postman & MTS cadre.
9.      Proper manning & beat arrangement of various offices after taking latest  EST-2 & EST-3 of various offices as per the departmental rules.
Note:- Due to functioning of “Nabannya” under the jurisdiction of Shibpur SO, huge mail are being received by Shibpur SO, but no extra manpower has been provided to that SO. Similarly, Post Offices like Santragachi, Baksara, GIP Colony and Delta Mill SO have been suffering due to daily receipt of heavy pressure of mail.

10.  Timely supply of good quantity computer papers, printers, scanners and other related accessories and computer peripherals.
11.  Non-settlement of various building problems providing urinals & latrines and arrangement of purified drinking water.
12.  Non-drawal of various allowances to the staff of this division without any valid reason.
Note:- Legitimate allowances for the staff of the division are denied by divisional authority without assigning proper reason.

               National Secretariat of  the Confederation of  Central Govt. Employees & Workers was held on 17th July, 2014 at New Delhi under the presidentship of Com.K.K.N.Kutty.  Com.S.K.Vyasji, Advisor was also present.
               The meeting held detailed chapter-wise discussion on the memorandum submitted to 7th CPC by the JCM National Council, Staff side.  The following decisions are taken.
1.     It is decided to submit a detailed memorandum by Confederation to 7th CPC before 31-07-2014 on common demands of the Central Govt. Employees incorporating all the acceptable suggestions / additions / alterations put forward by the rank and file membership and also leaders at State / CHQ level.
2.     In the maiden Budget of  Modi Government  none of the major demands of the  Central Govt. Employees such as DA merger, Interim relief, inclusion of Gramin Dak Sevaks under 7th CPC, compassionate appointment etc. are considered.  National Secretariat is of the considered opinion that submitting memorandum and interim memorandum to 7th CPC alone will not solve the problems of Central Government employees.  Educating the employees and Creating mass sanction of entire employees behind the demands is a must.  Hence,  it is decided to organise phased agitational programmes for settlement of confederation charter of demands.
3.     As it is indicated that AIRF leadership has expressed its willingness for a joint programme of action on common demands, the National Secretariat decided not to declare the Confederation’s nationwide phased programme of action, for the time being and wait for the outcome of the joint meeting being arranged by AIRF leadership.  National Secretariat authorised the Headquarters Office Bearers to declare the  phased  programme of action later on at an appropriate time.
4.     National Secretariat adopted a resolution on the continued attack by TMC hooligans on the working class of West Bengal and decided to organize   “West Bengal Solidarity Day ”  on 27-08-2014 throughout the country.  Copy of the resolution is appended.  All District / State COCs and affiliated organisations are requested to organise the programme throughout the country, in a befitting manner.

OBSERVE “WEST BENGAL SOLIDARITY DAY” ON 27-08-2014
RESOLUTIONADOPTED BY THE NATIONAL SECRETARIAT OF CONFEDERATION OF CENTRAL GOVT. EMPLOYEES & WORKERS HELD AT NEW DELHI ON 17TH OCTOBER, 2014 ON
CONTINUING ATTACKS ON THE PEOPLE AND WORKERS INCLUDING CENTRAL GOVT. EMPLOYEES OF WEST BENGAL AND SOLIDARITY TO STRUGGLES AGAINST SUCH ATTACKS.
               The National Secretariat meeting of the Confederation of Central Government employees & Workers held at New Delhi on 17th July, 2014 expresses serious concern on the continuing severe attacks and intimidations on the people and working class including Central Government Employees of West Bengal by the Trinamool Congress (TMC) led goons and anti-social elements for last 37 months since May 2011.  During this period more than 157 left parties and Trade Union activists were killed and the number is increasing every day.  Thousands are physically attacked and injured with police administration aiding and abetting such attacks and onslaughts.  Even after declaration of the election results on 16th May 2014 such attacks and intimidation have been continuing in full steam and 12 comrades including two women were brutally murdered.  Several thousands are ousted from their areas of work and residence.  More than 15000 comrades and activists have been implicated in false cases and many of them were even jailed for months together having been booked on non-bailable cases.  Molestation and rape of women by TMC hoodlums have become almost a frequent happenings in the state.  Latest has been the brutal rape of one Anganwadi Worker by TMC miscreants at Nadia District on 7th July 2014 and it is the same district where TMC MP had given open threat to get women raped by his men a few days before such dastardly incident of rape.  The police has been actively patronising such attacks.  After declaration of the election result, intensity of such attack has increased targeting the working people both in towns and rural areas.
               Democratic right of holding meetings, rallies etc. are being sought to be denied.  Refusal of permission by police administration to hold public meeting, even hall meetings, and using mike throughout the state at the instigation of TMC has become almost a regular affair.
SITUATION IN CENTRAL GOVERNMENT SERVICES:
               During last strike of 12th & 13th February 2014 TMC elements with a handful of employees raised anti-strike slogans and threatened the striking employees in Aykar Bhawan and G.S.I. HQ on both the days of strike.  However they could not break the strike.  Our comrades avoided the provocation. 
               During previous one day strike called by Confederation and also during two days strike called by Central TUs, attacks were launched by TMC hooligans at Barrackpore, Kalyani, Contai, Tamluk and few other places where striking Postal comrades were manhandled.  In a TSO of Barrackpore the Sub Postmaster was made to wear a garland of shoe and abused.  The same was propagated through electronic media in order to defame not only that particular comrade but also all strikers.  Botanical Survey of India employees are also under constant threat by TMC hooligans led by one Minister of West Bengal Government for last three years.  The Comrades who were manhandled during strike could not submit any FIR as they were afraid of being arrested by Police.  This is the order of the day in West Bengal; the victims of attack are being arrested and those who attacked are set free.
               Our Comrades specifically Gramin Dak Sevaks were compelled to leave their houses as they are supporters of left forces and carrying red flag of their union.  Attacks were made in the Conferences of Postal Union and Pensioners Associations in various places including Kolkata.  The displaced comrades could not attend offices and taking leave.  Few of them had to face disciplinary action for continuing on leave for more than 180 days leave.
               Administration specially in Postal Department taking advantage of this political situation are harassing and issuing charge sheets against NFPE comrades.  The appellate authority also reviews the punishment to enhance it.  Two comrades were awarded compulsory retirement.  Another comrade was also rewarded with same punishment after Rule 14 proceedings.  Those three cases were for launching demonstration.
               Attempts are being taken to change union by way of intimation and threats by the supporters of TMC.  In spite of it most of the new recruits are enrolling themselves in our unions due to sustained efforts taken by our Comrades.  The TMC Party leaders are intervening in the internal affairs of the Postal administration to get our organizers transferred.  The common employees specially lady employees are being transferred to inconvenient places and after putting them in inconvenience the transfer order is being reversed if the employee joins unions supporting TMC.
               Comrades all over the state are fighting for redressal.  But the same is not enough as situation is worsening day by day. 
CONFEDERATION CALLS UPON ALL CENTRAL GOVERNMENT EMPLOYEES TO OBSERVE “WEST BENGAL SOLIDARITY DAY” ON 27TH AUGUST 2014 THROUGHOUT THE COUNTRY
               National Secretariat of the Confederation while condemning such Government sponsored hooliganism in West Bengal, expresses full support and solidarity with the struggle of the people and working class and demands upon the State Government in West Bengal to put a stop to such attacks and onslaughts.  Confederation calls upon the entire Central Government Employees of our country to organize solidarity action and campaign against the ongoing brutalities by the fascist humpen-led TMC regime on the democratic people and working class of West Bengal.
               Confederation National Secretariat further calls upon all District/State units and also affiliated organisations to observe “WEST BENGAL SOLIDARITY DAY” on 27th August 2014, throughout the country.

Lokpal Act notified – Central Government Employees to declare assets of self, spouse and children.

         The central government has notified rules under the Lokpal Act making it mandatory for all its employees to file declarations of their assets and liabilities and those of their spouses and dependent children.

             It has issued new forms for filing these returns which have fields to give details on cash in hand, bank deposits, investment in bonds, debentures, shares and units in companies or mutual funds, insurance policies, provident fund, personal loans and advance given to a person or any entity, among others.

           The employees need to declare motor vehicles, aircraft, yachts or ships, gold and silverjewellery and bullion possessed by them, their spouses and dependent children, according to the form.
       They need to give detail of their immovable properties and statement of debts and other liabilities on first appointment or as on March 31 of every financial year.
There are about 50 lakh central government employees, including IAS, IFS and IPS, among others.
           The rules, Public Servants (Furnishing of Information and Annual Return of Assets and     Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014– were notified by the Department of Personnel and Training (DoPT) last week.
As per the rules, notified under Lokpal and Lokayuktas Act, every public servant shall file declaration, information and annual returns of his assets and liabilities as on March 31 every year on or before July 31 of that year.

       These declarations are in addition to such returns being filed by the government employees under various services rules.

      However, the competent authority may exempt a public servant from filing the information in respect of any asset if its value does not exceed his or her four months basic pay or Rs two lakh, whichever is higher, the rules said.

Reimbursement of Children Education Allowance - PIB NEWS.

It has been informed by the Department of Personnel and Training that the annual ceiling limit for reimbursement of Children Education Allowance (CEA) is Rs. 18,000/- per child. The Hostel subsidy shall be Rs. 4,500/- per month per child. The annual ceiling for reimbursement of CEA for disabled children of Government employees if Rs. 36,000/- per annum per child and the rates of Hostel subsidy for disabled children of Government employees is Rs. 9,000/- per child per month. These revisions are applicable with effect from 1st January, 2014. The reimbursement is admissible for children studying in institutions affiliated to any Board or recognized institution, whether in receipt of Government aid or not, recognized by the Central or State Government or Union Territory Administration or by University or a recognized educational authority having jurisdiction over the area where the institution is situated. No change is proposed to be made in the same.

This information was given by the Union Minister of Finance, Shri Arun Jaitley in written reply to a question in Lok Sabha today (18/7/2014)

FIRST BUDGET – NO DA MERGER, NO INTERIM RELIEF

Central Government employees have been eagerly awaiting the first budget of the new Government Inspite of one day strike and two days strike, the UPA Government was not ready to concede the genuine and justified demands of the Central Government Employees. Naturally, employees expected some good news from the maiden budget of NDA Government. But the budget has cast shadow on their expectations. Not only the Central Government employees but the common people and the working class are also totally disappointed.

The Union budget 2014-15, is an exercise in piloting large scale FDI & PPP mode in the financial and policy governance of the country. If followed the same policy of trajectory deregulation, privatization and corporate-orientation so long followed by its predecessor, the UPA Government, which has been rejected by the people in election.

While engineering a drastic cut in expenditure on almost all heads impacting common people aimed at containing fiscal deficit, the budget remained reluctant in taking any action in arresting organised pilferage from public exchequer in the form of deliberate tax default by big corporate houses which reached a huge sum of Rs. 4.18 lakh crores on account of Corporate tax Income tax by the end of 2012-13

Added to this, the decision to constitute the Expenditure Management Commission to look into basically the subsidies for common people aiming at further deduction in the same Budget has already proposed a cut in subsidy on petroleum to the tune of Rs. 22054 crores which would have a cascading effect on prices of all goods. Further the budget announced total decontrol of diesel pricing before the end of the current financial year adding further to the woes of the common people. The budget reduced the direct tax leading to a revenue loss of Rs. 22200 crore while increasing the indirect tax burden to the tune of Rs. 7525 crore.

The Budget announced raising of FDI cap in defence and insurance sector from existing 26% to 49% much to the detriment of the interests of national economy. The target for revenue from public sector Undertakings (PSU) disinvestment has been set at a huge amount of Rs. 63000 crore and the Finance Minister has announced that instead of earning dividend from PSUs. Number of measures have been incorporated in the Budget to actually weaken the public sector Banks making them easy prey of privatization policy of the Government.

On a whole, the first budget of the NDA Government has basically turned out to be grossly anti-people in character promoting more aggressive loot by the corporate and big-business houses on the mass of the people and working class.

Govt. should from a Transfer Policy in each department for transferring on mutual basis on promotion. Any order issued in violation of policy framed be cancelled by head of department on representation.

      The stipulation for TA that the Govt. employee should be on duty in his headquarters for certain number of days during the calendar month should be removed.

17.Special Pay which was replaced with Special/Allowance by 4th CPC be bring back to curtail pay scales.

19.Regularize all casual labour and count their entire service after first two year, as a regular service for pension and all other benefits. They should not be thrown out by engaging contractors workers.
20.The present MACPs Scheme be replaced by giving five promotion after completion of 8,15,21,26 and 30 year of service with benefits of stepping up of pay with junior and also hierarchical pay scales.
21.PLB being bilateral agreement, it should be out of 7th CPC perview.
22.Housing facility:-
(a) To achieve 70% houses in Delhi and 40% in all other towns to take lease accommodation and allot to the govt. employees.
(b) Land and building acquired by it department may be used for constructing houses for govt. employees.
23. House Building Allowance :-
(a) Simplify the procedure of HBA
(b) Entitle to purchase second and used houses
24. Common Category – Equal Pay for similar nature of work be provided.
25. Compassionate appointment – remove ceiling of 5% and give appointment within Three months.

(iv)  Allow accumulation of 400 days Earned Leave
(v)  Allow encashment of 50% leave while in service at the credit after 20 years Qualifying Service.
(vi) National Holiday Allowance (NHA) – Minimum one day salary and eligibility criteria to be removed for all Non Executive Staff.
(vii) Permit encashment of Half Pay Leave.
(viii)Increase Maternity Leave to 240 days to female employees & increase 30 days Paternity Leave to male employees.
37. LTC
(a) Permission to travel by air within and outside the NE Region.
(b) To increase the periodicity once in a two year.
(c) One visit outside country in a lifetime

38. Income Tax:
(i)   Allow 30% standard deduction to salaried employees.
(ii) Exempt all allowances.
(iii) Raise the ceiling limit as under:
(a) General – 2 Lakh to 5 Lakh
(b) Sr. Citizen – 2.5 Lakh to 7 Lakh
(c) Sr. Citizen above 80 years of age – 5 Lakh to 10 Lakh
      (iv) No Income Tax on pension and family pension and Dearness Relief.

39. (a) Effective grievance handling machinery for all non-executive staff.
(b) Spot settlement
(c) Maintain schedule of three meetings in a year
(d) Department Council be revived at all levels
(e) Arbitration Award be implemented within six month, if not be discussed with Staff Side before rejection for finding out some modified form of agreement.
40. Appoint Arbitrator for shorting all pending anomalies of the 6th CPC.
41.Date of Increment – 1st January and 1st July every year. In case of employees retiring on 31st December and 30th June, they should be given one increment on last day of service, i.e. 31st December and 30th June, and their retirements benefits should be calculated by adding the same.
42.General Insurance: Active Insurance Scheme covering risk upto Rs. 7,50,000/- to Non Executive & Rs. 3,50,000/- to Skilled staff by monthly contribution of Rs. 750/- & Rs. 350/- respectively.
43. Point to point fixation of pay.
44. Extra benefits to Women employees (i) 30% reservation for women.
(ii)   Posting of husband and wife at same station.
(iii) One month special rest for chronic disease
(iv) Conversion of Child Care Leave into Family Care Leave

45. Gratuity:
Existing ceiling of 16 ½ months be removed and Gratuity be paid @ half month salary for every year of qualifying service.
Remove ceiling limit of Rs.10 Lakh for Gratuity.
46. Pension:
(i)      Pension @ 67% of Last Pay Drawn (LPD) instead of 50% presently.
(ii)     Pension after 10 years of qualifying service in case of resignation.
(iii)    Increase pension age-based as under:
65 Years – 70% of Last Pay Drawn (LPD)
70 Years – 75% of LPD
75 Years – 80% of LPD
80 Years – 85% of LPD
85 Years – 90% of LPD
90 Years – 100% of LPD
(iv)    Parity of pension to retirees before 1.1.2006.
(v)     Enhanced family pension should be same in case of death in harness and normal death.
(vi)    After 10 years, family pension should be 50% of LPD.
(vii)   Family pension to son upto the age of 28 years looking to the recruitment age.
(viii) Fixed Medical Allowance (FMA) @ Rs.2500/- per month.
(ix)    Extend medical facilities to parents also.
(x)     HRA to pensioners.
(xi)    Improvement in ex-gratia pension to CPF/SRPF retirees up to 1/3rd of full pension.
